These Terms of Use ("Terms") govern your access to and use of the GeoTraders mobile application (the "App") operated by Adam Sawicki ("we", "us", or "our"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 13 years old to use the App. If you are under 18, you must have permission from a parent or legal guardian. By using the App, you represent that you meet these requirements.
If you are a parent or legal guardian allowing a minor to use the App, you agree to these Terms on behalf of that minor. You are fully responsible for the minor's use of the App, including their safety during gameplay, their compliance with these Terms, and any liability arising from their activities.
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to:
GeoTraders is a location-based game in which users hide and find items in real-world locations. Participation in the game requires you to physically travel to locations and grant the App access to your device's GPS.
The App is not a navigation tool. Map data and item locations displayed in the App are approximate and user-generated. Do not rely on the App for directions, route planning, or assessing the safety or accessibility of any location. Always use your own judgment and appropriate navigation tools.
By using the App, you acknowledge and accept that participation in a location-based game involves inherent risks, including but not limited to: physical injury, property damage, encounters with hazardous terrain or conditions, adverse weather, traffic, wildlife, and interactions with other people. These risks may result in serious injury or death.
You voluntarily assume all risks inherent to participating in a location-based game and accept responsibility for your own decisions and actions during gameplay.
Nothing in this section excludes or limits our liability for death or personal injury caused by our own negligence, or for any other liability that cannot be excluded or limited under applicable law, including mandatory EU consumer protection rules.
We do not control, verify, or guarantee the safety, legality, or accessibility of any location associated with items in the game. Items are placed entirely by other users, and we have no ability to inspect or monitor real-world locations.
Your safety is your responsibility. While using the App, you must:

You may create content within the App, including item descriptions, photos, comments, and reports ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the App.

The App features a virtual in-game currency ("money") that is earned through gameplay activities. This currency has no real-world monetary value, cannot be purchased with real money, cannot be exchanged for real money, and is not transferable outside the App. We reserve the right to modify the virtual economy at any time.
We reserve the right, but are not obligated, to monitor User Content and user behavior. We may take the following actions if we believe content or behavior violates these Terms, applicable law, or poses a risk to the safety of users:

In urgent cases involving immediate risk to safety or legal compliance, we may act before providing notice, but will inform you as soon as reasonably possible afterward.
If you believe a moderation action was taken in error, you may appeal by contacting us at [email protected] within 30 days of the action. We will review your appeal and respond within a reasonable timeframe. Our review will be conducted by a person, not solely by automated means.
The App and its original content (excluding User Content), features, and functionality are owned by us and are protected by copyright, trademark, and other applicable laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.
The App is provided on an "as is" and "as available" basis. To the extent permitted by applicable law, we disclaim all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. This does not affect any mandatory statutory warranties that apply under EU consumer protection law or the laws of your country of residence.

The App facilitates a game in which users interact indirectly through items they hide and find. We are not responsible for the actions, content, or behavior of any user, whether online within the App or in the real world.
We do not screen, verify, or endorse items placed by users, and we have no control over the real-world locations where users choose to place items. Any interaction you have with another user or with content created by another user — including traveling to a location where an item was placed — is entirely at your own risk.
To the fullest extent permitted by applicable law, we, our officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with:

To the extent permitted by applicable law, you agree to indemnify and hold harmless Adam Sawicki from and against any third-party claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:
This indemnification obligation does not apply to the extent that the claim arises from our own negligence or breach of these Terms. If you are a consumer in the EU, this section applies only to the extent permitted by the mandatory laws of your country of residence.
You may stop using the App at any time. You may request deletion of your account by contacting us at [email protected]. See our Privacy Policy for details on data deletion.
We may suspend or terminate your account at any time for any reason, including violation of these Terms.
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
We may update these Terms from time to time. For material changes, we will notify you at least 30 days in advance through the App or by email. The notification will clearly describe the changes being made.
If you do not agree with the updated Terms, you may stop using the App and request deletion of your account before the changes take effect. Your continued use of the App after the effective date of the updated Terms constitutes acceptance of the revised Terms. The "Last updated" date at the top indicates when these Terms were last revised.
These Terms shall be governed by and construed in accordance with the laws of Poland.
Any disputes arising from these Terms or your use of the App shall be subject to the jurisdiction of the courts located in Poland. However, if you are a consumer residing in the European Union, you retain the right to bring proceedings in the courts of your country of residence, and nothing in these Terms deprives you of the mandatory consumer protection rights granted by the laws of your country of residence.
The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obligated to participate in alternative dispute resolution proceedings, but we are committed to resolving disputes in good faith.
